Hello,

You asked if we had any comments or questions.

I work at Foxwoods. I am out on workman's comp due to repetitive motion in my right shoulder due to dealing. I have been out since Nov 9th and they did an MRI. They sent me to their doctor, who is not a real doctor or P.T .  They have one person that comes in once a month.

Now they are saying if I cannot go back to work and do my job by June 5th that I will no long have a job there. Can they do this? They have done it to a friend of mine. Is it right? I say no. When we have worked there for 7 years and are standups, why can't they give us a job on the floor. We already do it. Can you answer any of these questions? What can we do?

You must contact the Workman's Comp Board in your state. The laws on workman's comp are essentially the same in all states. The employer is required to place you in an alternate temporary job if you sustain an on the job injury, which you have.

Also, if the doctor they send you to reports that "in his opinion" it is not job related, then you are entitled to another opinion. If you get no support from the workman's comp people, call your state bar ass'n and ask them to refer you to an attorney who handles workman comp cases. Let us know how it works out. Good luck.
