"DEALER’S
SEEKING CLASS ACTION
AGAINST BIG TOBACCO"

It was
October 8, 1997. On that date exactly three years, six months ago,
the National Federation of Gaming Employees (NFGE) formerly
Nevada Casino Dealers Association (NCDA), filed a lawsuit
against the tobacco companies on behalf of casino dealers for the
injuries and risk of disease they suffered from second hand smoke
in the casino. This lawsuit is seeking compensation for all
non-smoking dealers who have worked as full-time employees for at
least five years.
It has been a long time and many people forgot
all about it, but you should know, things have been happening. Our
next order of business is to gain our certification as a class.
This is a watershed event. In order for our lawsuit to proceed we must
be certified as a class.
We have an excellent, dedicated legal team ---
but the tobacco companies, with their limitless money supply, also
have good lawyers. We now have an opportunity to show the court,
and the news media, and the nation, that we believe in our cause.
We have
charged the tobacco companies with negligence, fraudulent
misrepresentation, conspiracy and failure to warn, among other
things. These are serious charges and let me assure you, we can
prove them. But it is not simply compensation we wish. We also
want everyone to know the evil things the tobacco companies have
done. By publicizing their deeds we hope to stop them.
We ask that all dealers and all interested
citizens come to the courtroom. Show your support for this effort
and to let big tobacco know they must pay for what they have done
to us.
On April 27th at 9 AM there will be a hearing
in federal court with arguments from our lawyers and from the
tobacco lawyers about whether this case should be granted class
certification. The hearing will be held in Judge Phillip
Pro’s courtroom, Department 7 C, in the new Federal Building at
333 Las Vegas Blvd., South.
