We need everyone to
start gathering
signatures. Even if your
tips have not been
confiscated yet, you can
make sure it will never
happen to you in the
future.
This new petition if
passed would:
1. Make it illegal for
employers to decide what
classifications of
employees must
participate in a tip
pool.
2. Protect tipped
employees’ right to
participate in a tip
pool and to decide who
will be included in that
tip pool.
3. Protect existing
collective bargaining
agreements from being
invalidated, for example
Culinary Union contract
waiter-waitress-busboy
tip agreements.
4. Specifically allow
employees the right to
take employers to court
for violation of this
statute.
Instructions:
1. Have registered
voters sign the
petition. Please make
sure they are putting
the required information
in the correct places.
You must be a registered
voter in order to sign
the petition. You may
gather signatures at any
public building such as
libraries or the DMV.
You can ask people to
sign the petition at
businesses, however, if
the management at that
business asks you to
stop gathering
signatures at their
place of business,
please comply.
2. When you are done
gathering signatures,
take your petitions to a
notary public and have
them notarized. It
doesn’t matter whether
or not all the spaces in
each petition have been
signed. The notary will
know what to do in that
case. You do not have to
have each signature
notarized individually.
3. Affix a postage stamp
to the provided
envelope, put your
return address on it,
and drop it in a mail
box with the signed and
notarized petitions
enclosed. The address

4. We must have the
petition submitted to
the secretary of state
by November 11, 2008 so
make sure you mail it in
to the PEST Committee in
plenty of time to allow
them to count and bundle
the petitions.
